Johnson, lead writer for the Texas Fiduciary Litigator blog, presented his speech on a “Trustees’ Duty To Disclose In Texas” to the Tarrant County Bar Association’s Business and Estate Section’s membership lunch in Fort Worth, Texas, on October 20, 2016. This presentation covered the legal issues involved in a trustee’s duty to disclose as that duty is defined in the relevant trust document, statutes, common law, and discovery rules. The presentation also addressed the ramifications for a trustee not complying with its duty to disclose and methods for a trustee to resolve disputes regarding the duty to disclose.
